Definitions
"T&C" refers to Terms and Conditions.
"We/us/our" refers to TUKUTANE ONLINE.
"User(s)" refers to anyone using our website or Service.
"Service" refers to advertising/property listing service for properties within the Republic of Tanzania.
"Website" refers to https://tukutaneonline.com
"Agent(s)" refers to a registered User to advertise properties on our website.
"Materials" means property information including property and owners/agent photos, plot and farm maps, to be posted on our website.
Agreement
By using our Website and Service therein you agree to accept and comply with the following T&C as a User/Agent, referred to as ”you” or “your” hereinafter. You shall be bound by the T&C with respect to your access or use of this Website and any further upgrade, modification, addition or change to this Website, on which we reserve the right to update at any time without notice to you. If you do not accept all the T&C, do not use this Website.
Obligations
The User/Agent declare that they are of legal age and have the legal capacity to acquire the Services offered through the Websites and to assume the obligations set herein.
By registering with the Service, you agree to accept emails about your created account, other Service offers by DALALI MAKINI ONLINE. You will be responsible for the security of your account information, as you will be accountable for any activities conducted under your account. If your account has been accessed by someone else without your authorization, please report to us immediately.
Our Service is limited to provide a platform for Website User/Agent, and we do not take part of or take responsibility for any communications, negotiations, or transactions between User/Agent. However, we reserve all the rights to monitor Materials posted on the website, and the rights to terminate your access to the Service and information submitted for the Service at any time, without notice, for any reason whatsoever. User/Agent shall act in good faith to other parties and are responsible for the following.
An Agent is responsible for the following:
- To only advertise properties available within the Republic of Tanzania
- To provide/post Materials as required in compliance with the Obligations and not to post any misleading or false information that are not relevant to the property listed
- To maintain accuracy of information of Agent or Materials, and update when any changes are made
- To confirm Materials are correct and following the guidelines to be provided by TUKUTANE ONLINE. after Agent registration
- To remove sold or unavailable property from listings within a maximum period of 7 business days
- To obtain any mandatory authorizations regarding the Materials and properties. As User/Agent it is your responsibility to obtain the necessary legal advice as required
Materials Provided
When participating in any service you may provide us with information about yourself and/or products and services listed. You grant us exclusive rights in all this information, and all information derived or generated from it, in all existing or future media. These rights include but are not limited to the right to display your information anywhere, to search the information, and, consistent with our Privacy Policy, to repackage and resell it to anyone for any reason. As used in this paragraph, information includes but is not limited to data, text, photographs, drawings, sound recordings, feedback, and any other information or data displayed or presented in connection with your listings with us.
We always reserve the right to disclose any information as we deem necessary to satisfy any applicable law, regulation, legal process, or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in our sole discretion. See the Privacy Policy disclosures relating to the collection and use of your information.
Copyright
You may not copy, reproduce, recompile, decompile, disassemble, reverse-engineer, distribute, publish, display, perform, modify, upload to create derivative works from, transmit, communicate or in any other way exploit any part of the information or material obtained through the Website and/or the Website's material.
User Conduct
No User shall attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any our server or to any of the Services, through hacking, password mining or any other means.
No User shall make available any content to interrupt, damage, destroy or limit the functionality of our website or the Services.
No User shall make available any content to unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, invasive of another's privacy, or is harmful to minors in any way.
No User shall use the Service in any manner that is illegal, immoral, or harmful to us or in breach of any policy or other notice on our website.
No User should copy links or information from third party websites.
No User shall use the Services for purposes other than your own personal use or for advertising as an Agent.
Disclaimer
The features and Service on the Website is provided on the “as is” and “as available” basis, and we hereby expressly disclaim all warranty. Materials provided on the Website are for advertising purpose and whilst displayed in good faith, we will not in any circumstances accept responsibility for their accuracy. The use of our Website and Service is entirely at individual's risk.
Agent Access Rights and Listing Life Cycle
Agent can post a listing at a fee of TShs 40000.00 which will make a contract active for 90 days. After payment, listing will be visible to the public and after that period elapses it will expire and be unavailable to the public
Listing once saved, will only be visible to the public after it has been paid for
It is hereby asserted that renting term is 90-day period and renewable for another 90-day period
Agent can delete/edit listing which has not been paid for or which has expired. After payment, Agent can not delete or edit it
Agent will receive notifications to their registered email as the listing is approaching deadline and when it has expired. Once expired, it will be open for renewal/revival with the same conditions, fees and deadlines
Agent will be able to view their listing information any time as long as they have not deleted the listing
When a building becomes fully occupied before the expiry renting term/period, the Agent shall have no right to claim any refund for the unexpired Renting period
Upon expiry the Client has an option to renew for another period with existing operating fees and terms and conditions or delete the listing
Limitation of Liability
TUKUTANE ONLINE. Makes no representations or warranty about the validity, accuracy, correctness, reliability, quality, stability, and/or other problems with the information, products and Service provided.
Under no circumstances shall TUKUTANE ONLINE.be held liable for a delay or failure or disruption of the content or services delivered resulting directly or indirectly from acts of nature, forces or causes beyond its reasonable control, including without limitation, Internet failures, computer, telecommunications or any other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, flood, storms, explosions, Acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals or non-performance of third parties.
Applicable Law
This Agreement shall be governed by the laws of Tanzania. Judiciary of Tanzanian has the exclusive jurisdiction over any disputes in which TUKUTANE ONLINE is a defendant.
